Definition | The items in Class 10 comprise apparatus used in medical, dental and veterinary situations. The words "apparatus" or "instruments" are important as they help to differentiate Class 10 items from the medications and preparations in Class 5. Many of these devices are classified in other classes when not used for a Class 10 purpose. For example, needles are found in three classes other than Class 10. However, when the needles are specified as being for medical purposes or suture needles or acupuncture needles, they are in Class 10. Another factor to be kept in mind when working with Class 10 is that protective items for protection against further aggravation of an existing condition or illness are in Class 10 while protective items that are intended to prevent an initial injury are in Class 9. For example, shoes for protection against accidents, irradiation and fire are in Class 9. If the foot is injured in an accident, a support bandage that is in Class 10 is applied to assist in curing the injury by providing support to the foot. However, note that a wound dressing is in Class 5 since it provides protection and perhaps is a carrier for a medical preparation but, in itself, does not serve to cure the injury. |
